Service of Process in Wyoming is governed by the Wyoming Rules of Civil Procedure (WRCP). Below are the key rules:
Methods of Service
- Personal Service:
- Service may be made by delivering a copy of the summons and complaint directly to the individual.
- Delivery can also be made at the individual’s dwelling or usual place of abode with someone of suitable age and discretion who resides there.
- Service by Mail:
- Allowed if mailed via certified or registered mail, return receipt requested.
- The signed return receipt must be filed with the court as proof of service.
- Service by Publication:
- Permitted when the defendant cannot be located with reasonable diligence.
- The notice must be published in a newspaper of general circulation in the county where the action is filed for the duration specified by the court.
- Service on Entities:
- For corporations, partnerships, or associations, service may be made on an officer, managing agent, or any registered agent.
- If the entity has no registered agent, service may be made on the Wyoming Secretary of State.
Who May Serve
- Any person over 18 years old and not a party to the action.
- A sheriff or a deputy sheriff may also serve process.
Timeframe for Service
- Service must be completed within 90 days after the complaint is filed unless the court grants an extension.
Proof of Service
- A return of service must be filed with the court and include details of how, when, and where service was made.
- For mail service, the return receipt must accompany the proof.
